  • Recommendation:

    BE IT RESOLVED THAT subject to the consideration of any input received at the public meeting, it is recommended that the Committee of Adjustment grant conditional approval of Consent Application B24/01 subject to the following:

    1. That the Secretary-Treasurer’s Certificate under subsection 53(42) of the Planning Act R.S.O. 1990, c.P.13, as amended, shall be issued and the Secretary-Treasurer’s fees be paid.

    2. That the Owner verify, in writing:

    a) Whether the Lease Agreement is affected by any required or existing easements and/or restricted covenants, to confirm the necessary arrangements for servicing, shared parking and access are in place.
    b) That the subject property has been developed in accordance with the Approved Site Plan Agreement, and if necessary, the Site Plan Agreement is to be amended to include any required revisions and/or updates.
    c) That the Lease Agreement will not impact the existing parking areas and spaces provided within the subject property and that the parking areas and spaces will continue to be provided and maintained for the plaza generally and not limited to exclusive use by specific tenants, units or buildings, in accordance with the Zoning By-law and the Site Plan Agreement.
    d) That the Lease Agreement complies with and fulfills all pertinent provisions of the Ontario Planning Act.

    3. Approval of the draft reference plan, as applicable, shall be obtained at the Committee of Adjustment office (Town of Shelburne) and a digital file (PDF) of the resultant deposited reference plan shall be received; and,

    4. The conditions are to be fulfilled and the consent is to be finalized on or before two years from the date of the issuance of the Committee’s notice of decision.

  • Recommendation:

    BE IT RESOLVED THAT the Committee of Adjustment receive Report P2024-13 as information; 

    AND THAT subject to the consideration of any input received at the public meeting, it is recommended that the Committee of Adjustment grant approval of Minor Variance Application A24/02 for a property known municipally as 110 Adeline Street and described as Part of Lots 1 & 2, Railway Block, Plan 7A in the Town of Shelburne, County of Dufferin, to permit relief
    from the minimum required parking spaces and minimum interior side yard, subject to the following conditions:

    1. That the relief from the Zoning By-law is only for the following:

    a) a reduction to the required parking spaces from 18 parking spaces to 14 parking spaces which shall be provided and maintained on site, only for the existing office building and proposed building addition, and said parking spaces shall be located and maintained in accordance with an approved Site Plan;
    b) a reduction in the minimum interior side yard (west) abutting a residential use, from 2.0 metres to 1.26 metres, only for the proposed building addition for office use.

    2. That the Owner shall obtain approval of a Site Plan from the Town of Shelburne for the proposed building addition and related site improvements on the subject property.

    3. That the owner shall obtain a building permit for the proposed building addition.
